Welcome to The Art of Giving Permission (“TAOGP”). These Terms and Conditions (“Terms”) govern your access to and use of the TAOGP website, courses, programs, communities, books, digital materials, private sessions, and related products and services offered by Dr. Jason B. Fischer and TAOGP (“we,” “us,” or “our”).

By accessing our website, creating an account, purchasing a product or service, enrolling in a program, or otherwise using TAOGP, you agree to these Terms. If you do not agree, please do not use our website, products, or services.

1. Educational and Informational Purposes

TAOGP content, including courses, books, videos, exercises, workshops, community discussions, downloads, and other materials, is provided for educational and informational purposes.

TAOGP is not a substitute for medical care, mental health treatment, psychotherapy, diagnosis, or other professional healthcare services.

Participation in a TAOGP course, program, community, or other educational offering does not, by itself, establish a doctor-patient, therapist-client, or other healthcare-provider relationship with Dr. Jason B. Fischer.

If you have questions or concerns regarding your physical or mental health, you should seek guidance from an appropriately qualified healthcare professional.

2. No Guarantee of Results

Personal growth and educational experiences vary from person to person.

We do not guarantee that participation in TAOGP or use of its materials will produce any particular personal, professional, emotional, financial, relational, or other outcome.

Testimonials, examples, or participant experiences are individual experiences and should not be interpreted as guarantees that you will achieve the same or similar results.

3. Purchases and Payment

Prices and payment terms are presented at the time of purchase and are subject to change for future purchases.

By completing a purchase, you represent that the payment information you provide is accurate and that you are authorized to use the selected payment method.

If you select a payment plan, you agree to pay the entire purchase price according to the payment schedule presented at checkout. A payment plan is a method of paying the total purchase price and is not a month-to-month membership unless expressly identified as such.

4. Refunds and Returns

Except where otherwise required by applicable law, all sales are final and non-refundable.

Courses, programs, digital materials, memberships, private sessions, and other services are subject to our Refund Policy.

Physical books and merchandise are subject to our applicable Return Policy. Damaged, defective, or incorrect shipments may be eligible for replacement as described in that policy.

By making a purchase, you agree to the refund or return policy applicable to that purchase.

5. Memberships and Recurring Subscriptions

If you enroll in a recurring membership or subscription, you authorize us or our payment processor to charge the applicable recurring fee using your selected payment method until the subscription is canceled.

You may cancel a recurring subscription to prevent future renewal charges in accordance with the cancellation instructions associated with your account or membership.

Cancellation does not provide a refund or credit for amounts already paid or for unused time in the current billing period, except where required by law.

6. Intellectual Property

Unless otherwise stated, all content associated with TAOGP is owned by or licensed to Dr. Jason B. Fischer and/or TAOGP and is protected by applicable intellectual property laws.

This includes, without limitation:

  • The Art of Giving Permission name and methodology

  • Course curriculum and frameworks

  • Videos and audio recordings

  • Written materials and exercises

  • Workbooks, worksheets, and downloads

  • Graphics and website content

  • Presentations and training materials

  • Books and other published materials

  • Logos, branding, and original creative content

Your purchase or enrollment provides you with a limited, personal, non-exclusive, non-transferable right to access and use the materials for your own personal purposes.

You may not reproduce, distribute, publish, sell, license, modify, teach, transmit, publicly display, create derivative works from, or commercially exploit TAOGP materials without prior written authorization.

Purchasing access to TAOGP does not transfer ownership of any intellectual property to you.

7. Account and Course Access

You are responsible for maintaining the confidentiality of your account credentials.

Course or membership access is intended solely for the individual who purchased or was authorized to receive access. You may not share login credentials or provide unauthorized access to another person.

We reserve the right to suspend or terminate access when we reasonably believe an account is being shared, misused, used fraudulently, or used in violation of these Terms.

8. Community and Participant Conduct

TAOGP may provide communities, group programs, live sessions, cohorts, or other opportunities for participants to interact.

You agree to engage respectfully and not use TAOGP spaces to harass, threaten, discriminate against, exploit, or intentionally harm another participant.

You also agree not to solicit participants commercially, distribute spam, improperly collect participant information, or share another participant's personal information outside the program without permission.

We reserve the right to remove content or restrict or terminate participation when reasonably necessary to protect the community or enforce these Terms.

9. Participant Confidentiality

TAOGP encourages participants to respect the privacy of others.

Personal stories, experiences, or information shared by participants in group environments should be treated respectfully and confidentially. However, because group programs involve other participants, we cannot guarantee that another participant will maintain confidentiality.

Please use discretion when deciding what personal information to share in a group setting.

10. Private Sessions

Private sessions offered by Dr. Fischer may be subject to additional scheduling, cancellation, participation, or service terms presented when the session is booked.

Unless expressly established through a separate professional agreement, purchasing or participating in a TAOGP private educational or guidance session does not automatically establish a healthcare-provider relationship.

11. User-Submitted Content

If you voluntarily submit testimonials, comments, reviews, questions, or other content through TAOGP platforms, you represent that you have the right to provide that content and that it does not violate another person's rights.

We will not use your name, likeness, personal story, or testimonial for promotional purposes beyond permissions you have granted to us.

12. Third-Party Services

TAOGP may rely on third-party platforms and service providers for website hosting, course delivery, payment processing, email communications, scheduling, shipping, analytics, or other business functions.

Your use of certain third-party services may also be governed by those providers' terms and privacy policies.

We are not responsible for the availability, security, content, or practices of independently operated third-party websites or services.

13. Website Availability

We make reasonable efforts to maintain access to our website and digital services but cannot guarantee uninterrupted or error-free availability.

Temporary interruptions may occur because of maintenance, technical issues, third-party outages, updates, or circumstances outside our reasonable control.

14. Prohibited Uses

You may not use the TAOGP website, programs, materials, or services:

  • For unlawful or fraudulent purposes

  • To infringe intellectual property rights

  • To distribute malicious software or interfere with website security

  • To gain unauthorized access to accounts, systems, or content

  • To copy, scrape, reproduce, or commercially exploit protected content without authorization

  • To impersonate another person or misrepresent your affiliation with TAOGP

15. Limitation of Liability

To the fullest extent permitted by applicable law, TAOGP, Dr. Jason B. Fischer, and their respective affiliates, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our website, products, programs, or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TAOGP, Dr. Jason B. Fischer, and their respective affiliates and representatives from claims, liabilities, damages, or expenses arising from your unlawful use of our services, your violation of these Terms, or your infringement of another person's rights.

17. Privacy

Your use of TAOGP is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information.

18. Changes to These Terms

We may update these Terms periodically to reflect changes in our programs, services, business practices, or legal requirements.

The updated Terms will be posted with a revised “Last Updated” date. Your continued use of TAOGP after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

19. Governing Law

These Terms will be governed by the laws of the state in which the legal entity operating TAOGP is established, without regard to conflict-of-law principles, except where applicable consumer protection laws provide otherwise.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

21. Entire Agreement

These Terms, together with any applicable Privacy Policy, Refund Policy, Return Policy, checkout terms, program agreement, or other terms expressly provided for a particular product or service, constitute the agreement governing your use of TAOGP.
